New EU Rules Tighten Visa-Free Travel to Schengen Area

In a recent development, the European Union (EU) member states’ ambassadors have unanimously agreed upon stricter regulations concerning travel to Europe. This decision marks a significant shift in the policies governing visa-free travel to the Schengen countries.

Key Amendments

Under the revised legislation, the EU has introduced several amendments aimed at enhancing oversight and addressing the potential misuse of visa-free travel. The new regulations empower the EU to suspend visa-free travel for countries whose citizens are not required to obtain visas to enter the Schengen area. Key amendments include:

1. Non-Compliance with Visa Rules

The EU now has the authority to suspend visa-free travel for countries outside the EU if they fail to enforce visa regulations similar to those of the EU. This provision targets situations where lax visa requirements lead to a surge in immigration to the EU, particularly from neighbouring countries.

2. Investor Citizenship Schemes

The operation of investor citizenship schemes, whereby citizenship is granted without a genuine connection to the respective country, is now grounds for suspension. Such schemes, often based on predetermined financial investments, raise concerns about the integrity of the visa-free regime.

3. Addressing Security Threats

The EU has expanded its criteria for the suspension to include hybrid threats and deficiencies in document security legislation or procedures. This proactive measure aims to mitigate security risks associated with inadequate documentation and emerging hybrid threats.

Increased Suspension Period and Dialogue

The duration of temporary visa-free travel suspension has been extended from 9 to 12 months, with a possible 24-month extension (up from 18 months previously).

During this period, the European Commission will engage with the affected country to find solutions and address the concerns that led to the suspension.

Permanent Revocation as a Last Resort

If a satisfactory resolution is not reached during the dialogue phase, the EU retains the authority to permanently revoke the visa-free travel regime for the respective country. This underscores the EU’s commitment to upholding the integrity of its borders and safeguarding its interests.
