The New Zealand government has introduced stricter rules for accredited employers as part of an overhaul of its immigration system. The new regulations require employers to engage directly with Work and Income, aiming to prioritize local workers and improve the integrity of the labor market.

By streamlining the hiring process, the government seeks to ensure that employers thoroughly assess domestic candidates before considering foreign workers, strengthening the Labor Market Test and promoting fair employment opportunities for New Zealanders.

New Requirements for Employers

1. New Direct Engagement for Accredited Employers

Starting October 7, accredited employers will be required to communicate directly with Work and Income regarding their job vacancies.

Previously, immigration professionals handled these interactions, but the new directive encourages employers to take a more hands-on approach. This change primarily affects positions classified at ANZSCO Level 4 or 5 during the Job Check phase.

2. Advertising Requirements for Higher-Paying Jobs

For job vacancies offering a wage of at least NZD $59.32 per hour—double the median wage from February 2023—or positions listed on the Green List, employers must either advertise the role or engage with Work and Income.

This requirement ensures that New Zealanders are considered for job opportunities before employers look to hire migrant workers.

3. Strengthening Labor Market Integrity

The government believes that removing immigration specialists from the equation will enhance the Labor Market Test’s integrity.

By requiring direct communication, employers will be motivated to thoroughly assess the local labor market for potential candidates before seeking foreign talent.

4. Improved Communication with Work and Income

Previously, Work and Income faced challenges when only given contact details for immigration professionals.

The new system mandates that employers designate a specific contact person responsible for hiring decisions—such as a hiring manager, HR manager, or business owner.

5. Use of Recruitment Agencies Allowed

While employers must engage directly with Work and Income, they can still collaborate with external organizations, such as recruitment agencies. However, these agencies must be involved in the hiring process rather than solely providing immigration advice during Job Check applications.

A Step Towards a Robust Immigration System

This initiative is part of a broader strategy by the New Zealand government to reform temporary work visa policies in response to concerns from various sectors.

The changes are designed to bolster the integrity of the immigration system, ensuring that employers are accountable and actively considering New Zealanders for available roles.

Through these measures, the New Zealand government is working to create a more equitable labor market while maintaining the country’s appeal to skilled migrants.
