India’s New Immigration Bill: Stricter Penalties for Visa Violations and Overstaying

India has recently passed a significant immigration bill, introducing stricter regulations for foreign nationals. This move aims to enhance national security and streamline immigration processes. For travelers planning a trip to India, understanding these changes is crucial.  

Increased Penalties for Forged Documents

Anyone caught using a fake passport or visa to enter, remain in, or leave India will face severe consequences. The new legislation mandates imprisonment of up to seven years and a fine of up to Rs 10 lakh. This measure intends to deter fraudulent activities and reinforce the integrity of India’s immigration system.  

Mandatory Reporting by Institutions and Carriers

The new bill requires hotels, universities, hospitals, and airlines to report information about foreign nationals. This includes:  

• Reporting overstaying visas.
• Providing passenger and crew manifests to authorities.
• Sharing advance passenger information.

This comprehensive reporting system will improve the monitoring and tracking of foreigners within India.

Penalties for Unauthorized Entry

Foreigners entering India without valid travel documents, including necessary visas, will face up to five years in prison and a fine of up to Rs 5 lakh.

Streamlining Existing Laws and Enhancing Security

The Immigration and Foreigners Bill, 2025, replaces four existing laws, aiming to simplify regulations and enhance ease of compliance. It balances national security concerns with promoting tourism and economic growth.

Visa Information and On-Arrival Facilities

India offers various visa options, including electronic visas (e-visas) for citizens from 167 countries. Nationals from Japan, South Korea, and the UAE (with prior Indian visa history) can avail visa-on-arrival at six designated airports.

Registration Requirements and Restricted Areas

Foreigners on long-term visas (over 180 days) must register with the Foreigners Regional Registration Officer (FRRO) within 14 days of arrival. Pakistani citizens must register within 24 hours.

Certain areas in India, particularly in the northeastern region, Andaman and Nicobar Islands, and parts of Jammu and Kashmir, require special permits for foreign travellers.
